Ah I see. I only picked out examples from UK and Hong Kong before. Then: Symbol delete vote.svg Delete for those located in USA, Australia and Germany. I disagree. I think this is a correct list:

  • Symbol keep vote.svg Keep
  • UK, Hong Kong -- FOP OK for interior public space even with an admission charge
  • Australia -- the same as the UK
  • Symbol delete vote.svg Delete
  • USA -- no FOP for sculpture
  • Germany -- no FOP if the photographer is indoors
  • Netherlands -- the law does not permit an admission charge for FOP interior spaces
  • Austria -- while our summary says interior spaces are OK, it does not say whether that includes places that have an admission charge. The law simply says
"sich bleibend an einem öffentlichen Ort zu befinden"
"be located permanently in a public place"

so that does not help. Until we get that clarified, I think we must assume that it does not include places that charge admission.

There is also the question of "permanent". We have generally made a judgement call on this. It is safe to say that Winston Churchill is "permanent" in the UK museum, but we have not generally kept sculpture of people whose fame is much less clearly long lasting. As I noted above, we have no evidence that Austrian FOP extends to places that charge admission. Unsupported assertions do not help the discussion. As for the other countries, I'm afraid that the precautionary principle must lead to Symbol delete vote.svg Delete as photographs taken where there is a charged admission will suffer from significant doubt as to valid commercial reuse, unless someone can point to tacit or explicit conditions for the exhibition to allow for it, or the photographer was specially invited (such as at a behind-the-scenes event) or someone can work out a wrinkle beyond FoP in the legislation of the country (such as protection for political parody).
