台湾地区全景自由条款[edit]

多有打扰。

经两次向台湾地区主管部门电邮询问，分别得到回复，其中第一次回复已刊载在電子郵件1111122（核心在于第一点之（二），其余部分系对我邮件中部分内容的误解而产生的无关回复）。由于第一次回复中第一点之（二）仅列举了涂鸦这种平面美术作品，虽然其后括号注释“美术著作”，但对立体美术作品的适用性似乎没有明确指出，故本月我又去信询问，并就我在Commons_talk:Copyright_rules_by_territory/Taiwan中指出的台湾的规定没有单独规制贩卖行为提出疑问。今得回复（预计下月初刊载在同一网站）称第一点之（二）之说理同样适用于立体美术作品，即以立体美术作品为主题或拍摄重点，同样不能专以贩卖为目的重制（即拍摄）。同时对于他人以非贩卖目的进行复制后再授权他人使用，他人将复制物贩卖亦构成侵权（类似维基共享资源的情况）。按照台湾地区主管部门的上述解释，台湾地区的全景自由规定与日本法完全相同，此时对于维基共享资源的适用性即为：

OK对于建筑作品。
Not OK对于所有美术作品（包括平面和立体）——因并非完全自由，禁止贩卖。

诚然，正如阁下在Commons_talk:Freedom_of_panorama/Archive_17#FOP_in_Taiwan中所列举的，有其他学者对此有不同观点。本问题牵扯事项较多，否定台湾地区全景自由条款在维基共享资源情境下不适用于任何美术作品后中文维基百科中的许多条目想必都会受到影响，同时会涉及到是否引入日维方针允许以低分辨率【原美术作品合理使用+照片以可被接受的许可证许可】上传到本地的问题（例如日维的这个文件）。故前来询问阁下意见。 Teetrition (talk) 05:41, 30 December 2022 (UTC)Reply[reply]
